Recording regulatory matters

Learn how to use Corterum to maintain a record of individuals involved in matters relating to regulators.

As part of compliance with the SM&CR, a record should be made of all occasions where the conduct or duties of an individual in your firm have been subject to regulatory matters, such as suspension by a regulator, or if they performed the role of a Senior Manager Function (SMF) without the regulator's approval. These matters could have an impact on your assessment of the individual as 'fit and proper' to perform their role, so it is vital that thorough records are kept.

Here's how:

  1. Click WORKBENCH and then click DATASETS.

  2. Then click SM&CR.

  3. Then choose Certification Regime.

  4. Then click on Fit and Proper testing.

  5. Then click on Fit and Proper Assessment Criteria.

  6. Then click on Honesty, Integrity and Reputation.

  7. Then click on Regulatory matters.

  8. A list of all people in your firm for which you have recorded Regulatory matters will appear (if any have been created).

  9. If the person already has a log of Regulatory matters, and you're adding a new entry or updating information already held within the system, click on that person's name and skip to step 11.

  10. If a record of Regulatory matters for the member of staff has not yet been created, you would need to create a new one - click the PLUS (+) symbol next to REGULATORY MATTERS in the middle of the screen.

  11. A new pop up window will appear.

  12. If this is a blank table, with no information in it currently, skip to step 13. Otherwise if there is already information here you can update an existing row here by clicking the EDIT button, or add a new record of a Regulatory matter for the same person by clicking ADD ROW, and following the steps from step 14 below.

  13. You can give a descriptive name to this dataset under Dataset description, and then choose the name of the person entity undergoing the Criminal proceeding from the dropdown list next to Regulatory matters. NB - if the person who is the subject of these Directorships and Positions of Trust doesn't appear in this list, you'll need to create them as a Person Entity first - here's how).

  14. In this table dataset (reading from left to right) you can:

    1. Use the Regulatory matter dropdown box to record the type of regulatory matter in question.

    2. Use the text field under Regulatory matter (if other) to provide details if you selected 'Other' in point a above.

    3. Use the date picker under Date of Regulatory matter to record the date on which the Regulatory matter fell.

    4. Use the text box under Details to record the details and background behind this Regulatory matter

    5. Finally you can click the button under Documents to upload any supporting documents that may be required for this request.

  15. Once done, if you need to add additional records of Regulatory matters for this individual click ADD ROW and repeat the steps under point 14 above until all necessary matters have been recorded.

  16. Finally, click SAVE and then CLOSE.
